Access to the ITS Online Shop
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
Refunds - Your Statutory Rights
Cooling-off Period
By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered.
This applies to all of our products except for digital items where the item has been downloaded.
We regret that we also cannot accept cancellations of contracts for the purchase of e-Learning vouchers where the voucher has been redeemed
or software products where the item has been unsealed except where the product is deemed faulty, or for
services provided within seven working days: if you agree that you want a service to begin before the end of the cooling-off
period you will not be entitled to cancel once that service has started.
To cancel your purchase within the seven-working-day cooling-off period, please email eshop@itsgroup.org.uk
giving as much detail as possible and the reason for the return and we will advise you on how to return it.
Please note that we cannot accept returns if you simply deliver them to us by hand without notice.
For your protection, we recommend that you use a recorded-delivery service if posting.
Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective.
If we do not receive the item back from you with the delivery slip, we may arrange for collection of the item from your residence at your cost.
As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge if it has not yet been despatched--we cannot refund any priority, express or courier component of the postage charge.

Use of your information
1.1 Compliance with Data Protection legislation.
Where appropriate and in particular as set out in Clause 1.2 Customers shall be responsible for ensuring that any formalities required by the Data Protection Act 1998 and any other legal statute, enactment or requirement of any relevant jurisdiction including without limitation UK and EU Law entailing or flowing from this Agreement are complied with and shall indemnify the Company against any claims resulting from a breach of this provision.
1.2 Data Subject's consent to processing.
If Customers have provided information about Delegates, Customers agree that the Company may use such information to contact Delegates by email, telephone or post for the purposes of delivering the Training Course and specifically to send Delegates a Course Pack and agree that they have the Delegate’s consent to such activity.
1.3 Data subject's requests.
The Data Protection Act in the UK (similar legislation is in force in other EU Countries) allows Individuals to request that we provide them with details of personal information we hold about them and/or request that we do not process such information. If you wish to make such a request, please apply in writing to the 'Data Compliance Officer’ at the Registered Office address as set out below. An official fee may be payable.
1.4 Incorrect information.
If any individual believes that any information we hold about them is incorrect or incomplete they should contact the 'Data Compliance Officer' at the address below and request that the information be amended. The Company will use reasonable endeavours to amend such information promptly.
1.5 Transfer of data outside the EEA.
The internet is global and data crosses international borders in ways which cannot be predicted. Any use of email or the internet by Delegates or Customers or the Company may entail a transfer of data outside of the EEA and Delegates and Customers consent to these data transfers.
